1. Seller’s Identification, Scope of application, and Acceptance of the General Terms and Conditions of Sales

“Kinscent”, “we” and “our” refer to Kinscent Co., Ltd., the controller of your personal data as a distributor at Kinscent, unless otherwise stated in the Privacy Policy.

  • We are a limited liability company duly registered in Japan and headquartered at 9F, 2-2-15, Minami-Aoyama, Minato-ku, Tokyo.
  • Kinscent is a retailer and distributor of perfumes operated by the Kinscent Co., Ltd. Information about the company can be found at the following URL: https://kinscent.net/

To contact the company, please use the “Contact Us”.

The purchase of any Products offered on the www.kinscent.com website (the “Website”) and or/by phone is subject to these General terms and conditions of sales (General terms and conditions of sales”). 3

Accordingly, you agree and warrant that you will act as an end consumer and will not, directly or indirectly, resell for commercial purposes any products sold by Kinscent that you purchase through the Website and/or telephone.

We may update these Terms and conditions of sale at any time. You can view the applicable version of the Kinscent General terms and conditions of sales at any time by clicking on “Contact Us”. The sales agreement between you and Kinscent will include the conditions of your order and the Kinscent General terms and conditions of sales applicable at the time of your purchase, which apply to the exclusion of any other terms and conditions or any terms implied by trade, customer, practice, or course of dealing.

For each purchase of Products, you will be requested to confirm your acceptance of the current Terms and Conditions of Sale applicable at the date of your order. The said terms and conditions may be viewed prior to and at the moment when you are prompted to confirm that you accept them. To indicate your acceptance, you will need to check the box “I accept the Kinscent General terms and conditions of sales and consent to the processing of my data, in accordance with Kinscent’s Privacy Policy”. You can view the applicable version of the Privacy Policy at any time by clicking on the “Privacy Policy”.

2. Subscription conditions

2.1. Acceptance of our subscription conditions

You must read and agree to the General Terms and Conditions of Sales. If you do not, you may not make any purchases.
Kinscent reserves the right to change or modify the General terms and conditions of sales at any time. The applicable General terms and conditions of sales will be those in effect on the date of subscription.

In order to best accommodate your preferences, the list of products offered on Kinscent’s website is subject to change at any time depending on product availability.

Subscription:
Ships on the 1st of the following month if the subscription is completed by
the 15th of the month. In the case of weekends and holidays, shipping will
begin on the next business day of the delivery service provider. Products are generally shipped as selected by Kinscent.

No returns or exchanges are allowed.

Cancellations will be accepted up to 1 business day prior to the 15th, but no
cancellations of any kind will be accepted after that date.

2.2.Confirmation of the subscription

After selecting subscription items and reviewing all subscription details, total amount, and general terms and conditions of sale, you will receive an email from Kinscent confirming that your subscription was successfully registered, or you can check it on “My Page” on the Kinscent website. All subscriptions will receive a confirmation email. Please keep this document as proof of your subscription.

In exceptional cases of insufficient stock, Kinscent may cancel your subscription and will notify you by email or on “My Page” of the Kinscent website as soon as possible.

2.3. Product availability and validity period of your subscription

If a subscription is made during the business hours of the Kinscent website, the availability of the product on the Kinscent Website will be returned within 24 business hours of the subscription request.

Subscriptions made outside of Kinscent Website business hours will be processed on the next business day.

You will be notified of the availability of your subscription via email or “My Page” on Kinscent, according to the contact information you provided at the time of booking.

In exceptional cases, Kinscent may have to change the time or date of the originally scheduled subscription collection. Kinscent will notify you of any changes to the subscription status of your subscription.

Cancellation of a subscription period for selected items will be accepted up to one business day prior to the 15th of each month, but no later.
Cancellations after that time will not be accepted under any circumstances. If not canceled within this period, the subscription will not be canceled and the item(s) will be shipped as scheduled on the 1st or the next business day if it falls on a weekend or holiday. No returns or exchanges will be accepted.

2.4. method of collection

Customers may pick up their products at your home mailbox or by the nearest shipment service.

If you request someone other than the customer to pick up the items, you will need to prepare the following items according to the courier’s instructions. Please ask your local shipping company for details.
Example;

  • A tracking number
  • Your ID
  • A copy of your ID
  • Your signature or seal
  • Power of Attorney

Please note that the operation of delivery is the responsibility of the shipping company and Kinscent cannot change or cancel any receiving method.

Kinscent retains full ownership of the subscription requested for purchase until the subscription is paid for in full. All risk as to the product passes to the customer upon shipment of the product.

3. How to place an order

If you have any questions about our products or your order, please contact Customer Service by clicking on “Contact Us”.

This website does not specifically permit the creation of products, custom-made products, or special orders that do not exist in our current product line or are not part of the Kinscent Collection. The same applies to the creation of products. Therefore, these General terms and conditions of sales do not apply to special orders. For special orders, please contact our customer service by clicking on “Contact Us”.

This website may be used to order our products for shipment internationally. For detailed international shipping information, you may contact your local shipping carrier after your purchase details have been shipped.

4. Product availability

4.1 Services Related to Pre-Orders

Pre-orders allow customers to reserve certain products advertised on the Site (“Pre-orders” or “Reserved Products”) prior to the release date.

4.2 Availability of Products

Product offers are valid while supplies last. At the time an order is confirmed, there may be a difference between electronically available inventory and existing physical inventory (e.g., in the case of simultaneous orders of the same Product by multiple customers). Accordingly, sales are subject to the availability of the Product.
In addition, Kinscent retains the title to the Product until receipt of the Product.

The availability date for pre-ordered Products will be clearly indicated on the Product Form. If the availability date changes, you will be notified immediately via email and/or your account page. If the Product is no longer available after you have placed your order, we will notify you by email as soon as possible. It is your responsibility to cancel your order as soon as possible and you will be entitled to a refund by your payment method.

We shall not be liable if a product is out of stock or unavailable.

We reserve the right to change the products offered on the Site at any time and without notice. We reserve the right to limit the number of products available for purchase per customer in order to improve our quality service and provide more of our products to all customers.

5. How to order

5.1. How to order on the site

a) Product Selection

Customers may add products to their selection at any time by clicking “Add to Cart” and choosing to complete the order or continue shopping.

By clicking “Cart” from the menu in the upper right corner, customers can view their selections by viewing the photo, reference number, selected quantity, unit price, and subtotal of the selected products.

b) Login

Once you have selected your products, click “Checkout” to begin the order process.

If you already have a customer account, you will need to log in and/or enter your password at this stage. If you do not have an account, you will be asked to confirm your e-mail address and create a password. Your login and password are strictly for personal use only. You, therefore, undertake to keep them secure and never disclose them to third parties. You are also required to notify Kinscent immediately if you become aware that a third party has accessed your login, password, or account.

Once you create an account, you will be able to

  • Check the status of your shipments and view your order history
  • Return or exchange merchandise
  • Add or edit your shipping and billing addresses for future orders
  • Manage your Kinscent newsletter subscriptions

You can deactivate it at any time by deleting your account. However, the product will be retained after your shopping is complete. The shipping process will proceed after your purchase. Please note that returns, exchanges, and other support requests cannot be accepted after your account has been deleted.

5.2 Confirmation of orders placed on the website

5.2.a) Confirmation of Shipping Method

You must confirm the shipping method and enter the shipping information (shipping country, first name, last name, phone number, shipping address, and any other information or details we request) necessary to successfully ship your order.

Once you have completed this step, click “Continue”.

5.2.b) Payment Confirmation

You may use your shipping address as your billing address, or you may enter a different address. You will then be asked to select a payment method (see 6. prices – acceptable payment methods”) and enter the relevant information.

At the end of the above order process, you must click on the “Order and Pay” button after fully agreeing to the Site’s Terms of Sale and Use and Privacy Policy.

In addition, in order to confirm pre-order items or items requiring long-term handling, the customer must authorize Kinscent to retain the customer’s bank information for up to two months before the product is shipped and for debit after shipment.

Customers should carefully verify that the products selected are correct before confirming an order. While every effort has been made to ensure that the colors, designs, and fragrances of the products pictured on the Site match the actual products, differences may occur, particularly depending on the limitations of the color display of your computer equipment and the way you use the item. Therefore, Kinscent cannot be held responsible for any errors in the photos, images, or fragrances of the products shown on this site. Any inquiries regarding this product should of course be directed to our customer service.

For information on payment methods (currency, payment method, etc.), please refer to “6. prices – acceptable payment methods” below.

Once your order is placed, your order will be sent to Kinscent for processing.

The customer’s order shall be accepted by Kinscent upon notification from Kinscent to My account Page indicating that the order has been shipped or is ready for pickup. The purchase agreement between you and Kinscent with respect to your order shall become effective upon Kinscent’s receipt of your order, payment in full, and notification to you on your Customer Page that your order is ready for shipment or pickup. If part or all of an order is unavailable, Kinscent will contact the customer to determine whether to proceed with the available portion or cancel the order altogether.

Kinscent reserves the right not to accept an order from a customer if there is a dispute regarding a previous order or if Kinscent has reasonable cause to suspect that such a customer is in violation of these the General terms and conditions of use.

5.3. procedure for requesting an order for a product not listed on the site

You may place an order for Products by contacting our Customer Service through Contact Us (see “3. How to Place an Order”). To place an order, the Customer must provide the following information (“Order Details”)

  • Product details: the name and/or reference number of the product(s) requested, the quantity required, and, if applicable, the size, material, fragrance, and any other identifying information we may require.
  • Personal information: your first name, last name, telephone number, e-mail address, shipping address, and billing address (if applicable).

We will inform you whether the requested product is available and, if so, the purchase price of the product, the expected collection or delivery date, and the delivery cost. The shipping address information provided by the customer must appear on the shipping label and must be accurate. If the information provided is inaccurate, it may result in a delay or loss of your order. If the information provided is inaccurate, Kinscent is not responsible for exchanges or refunds.

If you choose to proceed with your order, you will be sent an email or text message (depending on the means of communication you choose) containing a link to an external payment platform. Clicking on the link will take you to the payment platform, where you will be able to review the details of your order and a summary of the purchase price (“Order Data”). Before making payment, the Customer must verify the accuracy of the Order Data.
For information on payment methods, please refer to “6. prices – acceptable payment methods”.

After reviewing the order data, providing your full name, and payment information, and agreeing to these General terms and conditions of use and Kinscent’s Privacy Policy, you may proceed to pay for your order by clicking the “Pay” button Kinscent will not have access to your bank account information.

Once payment is completed, you will receive a summary of your order. We recommend that you keep this email. Kinscent will then process your order.
The order summary does not indicate that Kinscent has approved your order. Customer’s order will be deemed approved by Kinscent upon Kinscent’s written notice to customer that it has been shipped or is ready for pickup. The sales contract between customer and Kinscent with respect to Customer’s order shall become effective upon Kinscent’s receipt of Customer’s order, payment in full, and written notice that it has been shipped or is available for pickup. If part or all of your order is unavailable, we will contact you to determine whether to proceed with the available portion or cancel your order altogether.

The Products will be shipped to the shipping address specified at the time the order is placed. You will be notified on My Page whether the Product is available for delivery to your shipping address, and Kinscent will notify you at the time you place your order.

5.4. Invoices

You can download an electronic invoice in the “Your Orders” section of your personal account. Your account is automatically created for each order. To access your electronic invoices, please log in to your customer account. If you have never logged in, click on the account confirmation email you automatically received. This will allow you to create a password. We make every effort to ensure that our communications reach you in a timely manner. However, there are times when reflection may be slow, such as when there are delays in some server linkages. In the unlikely event that your message has not been reflected after a few days, please contact Contact Us.

You can also create a new password directly on the website by clicking on “Forgot Password” and entering your email address.

If you would like to receive a printed copy of your invoice, you can do so yourself through My Page. Please note that we do not accept invoices other than those specified by us.

5-5. Parallel imports

Parallel imports are products imported from other countries. They are products imported into Japan through non-authorized import agents approved by the manufacturer.
Products not yet released in Japan are available for purchase, but we do not provide support. Parallel imported products that are sold and shipped are subject to the terms and conditions set forth by the manufacturer, but we do not provide warranty service by authorized import agents or manufacturers. The manufacturer may have its own warranty, so please check before purchasing.
Product packaging and instructions may not be written in Japanese. Specifications may differ from those of products handled by authorized distributors, or there may be restrictions on use in Japan.
Parallel import products may have errors in product boxes or decorations due to differences in purchasing routes. Parallel import products are mainly purchased from Europe. Designs and manufacturing depend on these manufacturers, not only domestic ones. Please contact the manufacturers for information on the nature of their products.

6. Prices – acceptable payment methods

6.1. Price

Prices of Products are quoted in the currency selected and include taxes, and Kinscent shall not refund any applicable taxes on purchases made on the Site, except in the case of i) exercising the right of withdrawal, or ii) refunds due to lack of conformity and hidden defects (as well as for re-export of Products received by the Customer).

Kinscent reserves the right to change the prices of products listed on the Site at any time without notice. Products will be invoiced in accordance with the price list posted on the Site at the time of order and subject to the availability of the ordered products at that time.

All orders are payable in the currency selected by the payer’s system and must be paid immediately upon order placement. If any of the products ordered are not available (see Article “4. Product availability”), only the price and shipping costs of the available products shall be invoiced.

6.2 Accepted Payment Methods

6.2.a) Payment by credit or debit card

We accept the following credit and debit card payments: Visa®, Mastercard®, Maestro®, American Express®, and JCB®. Debit card payments are authenticated and secured by the 3D Secure system. This system is also known as Verified by Visa®, MasterCard® SecureCode, and American Express SafeKey®. At the time of payment, the bank asks the Internet user for personal information to verify the cardholder’s identity and complete the transaction.

How to pay with 3D Secure at Kinscent.com.

After your bank account details (card number, expiration date, and card verification number) have been verified, you will be taken to a new page where you must enter the personal information requested by your bank. This information includes the following:

  • Answers to personal questions
  • The password you previously chose
  • The code was sent to you via SMS
  • Your date of birth, etc.

Once you have entered your 3D Secure code and it has been verified by your bank, your order is complete. You will then receive a confirmation email.
Authentication varies from bank to bank; if you have any questions about the 3D Secure code, please contact your bank directly.
Your order will be shipped after your payment method is verified and your card is authorized to be debited.
Your account will only be charged when the items are shipped.

6.2.b) Payment by PayPal

Payments can be made via PayPal. When you complete an order, you will be automatically redirected to the PayPal platform, where you will need to log in to your account; if you do not have a PayPal account, you can create one; once your order is confirmed by PayPal, you will be redirected to a confirmation page on Orders completed using PayPal may require additional delivery time. We are unable to accept PayPal payments for exchanges.

7. Reservation of title

The goods ordered shall remain the property of Kinscent until Kinscent receives full payment for the goods.
However, from the time the goods are shipped to the address specified in the order, the customer assumes all risks associated with the goods, especially risks associated with loss, theft, or damage.

8. Delivery method

8.1. Delivery and Collection Area

Products purchased on the Website will only be delivered to specific locations (excluding the Channel Islands) provided by the Company (“Delivery Area”).
Orders cannot be placed to destinations located outside of these Delivery Territories.

For security reasons, among others, Kinscent shall not process orders for which a generic shipping address, P.O. Box is provided.

Delivery to forwarders is excluded, as this product is intended for end consumers within the delivery area defined above.

The Product will be delivered to the delivery address specified at the time of order.

We reserve the right to require a signature and valid identification (e.g. passport or driver’s license) upon delivery.

8.2. Shipping charges

Shipping charges are included in the product price.
For international shipments, additional shipping charges may apply. The average price of international shipping costs can be checked by the customer.

Final shipping costs, including international shipping, can be found on the “After Purchase” page.
Please note that we do not accept cancellations after purchase. For inquiries about special orders involving international shipping, please contact “Contact Us”.

8.3. Time required for delivery and collection

At the beginning of the order process, you will be informed of the time frame required for delivery. The estimated delivery time can be found in the order summary. The following delivery times are calculated from the time the order is confirmed. However, for pre-ordered products, the delivery time is calculated from the time the product becomes available.

8.3.a) Delivery time

Domestic (Japanese) delivery times:

  • 3 to 4 business days for all orders placed and validated before 1 p.m. on a business day
  • 4 to 5 business days for all orders placed and validated after 1 p.m. on a business day

UPS Standard delivery times:

  • 8 to 9 business days for all orders placed and validated before 1 p.m. on a business day
  • 9 to 10 business days for all orders placed and validated after 1 p.m. on a business day
  • For delivery to small islands and distant locations: 11 to 20 business days following the order

However, Kinscent reserves the right to divide your order into several shipments. Your credit or debit card shall then be charged accordingly to correspond to the price of the Products actually shipped. The shipping costs shall only be charged for a single shipment in accordance with the information contained in your order summary.

8.3.b) Delivery to the mailing address

At the beginning of the order process, we will inform you of the products purchased and the country of delivery, the time required for delivery, and the various shipping methods available. Any additional shipping charges, if any, will be paid separately from the price of the purchased products.

9. Delivery Problems

Any non-delivery, late delivery, or unavailability beyond the delivery time stated in “8.3. Time required for delivery and collection” must be reported to the delivery company as soon as possible.

In the event of an acknowledged claim being notified to us within 3 calendar days from the date of order confirmation, Kinscent shall be obligated to reimburse the Customer for the full amount paid, at the latest, within thirty 30 days from the date of termination of the purchase agreement. However, if you receive the Product after exercising this right, you shall return the Product in accordance with the return procedure set forth in 10. Returns and refunds below.

Upon receipt of delivery of the Product, the customer shall check the conformity of the Product and, in the event of any abnormality (e.g., opening, damage, etc.), shall handwrite and sign a statement on the delivery receipt to the effect that the contract is as specified by the Company.

After that, please contact the Customer Service Center (see “3. How to place an order”). If the product differs from the order, the customer may request the return, exchange, or refund of the product in accordance with the conditions set forth in “10. Returns and refunds”.

10. Returns and refunds

Since the sales contract is concluded at the discretion of the customer, we cannot accept returns or refunds at any time. In case of defective products or incorrect delivery, please contact us first.

Please note that even in the case of defective or incorrectly shipped products, we may refuse to refund or accept a return if any of the following conditions apply;

  • If the customer has not contacted our Customer Support Desk with an inquiry in advance.
  • The date of receipt of the returned merchandise is more than three 3 days from the date the customer received the merchandise
  • If you have not been able to contact us for 3 days counting from the date of arrival of the returned merchandise.

Please note that we do not accept returns or refunds for products purchased outside of this website.

11. Exchange

11-1. Purchases made on this site

For hygiene and safety reasons, please note that we cannot accept any exchanges for products purchased on this site. In case of defective products or incorrect delivery, please contact us first.
If you wish to exchange the product, please contact us via Contact Us. After that, please share the necessary information with us and return the product and the set of accessories that you wish to exchange. Please note that in the following cases, we may refuse the exchange and return the product to you.

  • If the customer does not contact us in advance via the “Contact Us” form.
  • The returned merchandize arrives more than 3 days after the date the customer received the merchandized.
  • If the customer does not contact us in advance via Contact Us.
  • Signs of use are observed
  • Some parts of the product are missing
  • Accessories included in the shipment from us are missing

After confirming the condition of the returned product, we will proceed with an exchange. In principle, exchanges are limited to one time for the same product, subject to availability.
Please note that we do not accept orders placed through the website for the purpose of securing replacement merchandise. Please be sure to consult with our customer support via the “Contact Us” form in advance regarding the replacement product.

11-2. Shipping and returns

In the case of an exchange for the customer’s convenience, the customer is responsible for the shipping costs of delivering the product (to us).
When returning an item, please send the following items together with the product in the same condition in which it was received. If any item is missing from the returned merchandise, we will refuse the exchange.

  • Same merchandise
  • Replacement sheet to be prepared (customer and purchase information as specified by our customer support)
  • Instruction manual (may not be available for some products)
  • Delivery note
  • A complete set of accessories that were included in the package when the product was delivered

Please note that we are not responsible for any loss, misdelivery, or delay in delivery of the product during the return process for which you have requested a return.

12. Legal and commercial guarantees

12.1. Legal guarantees

Legal guarantee of conformity
Kinscent will deliver to the customer a product that conforms to the purchase contract at the time of delivery of such product and is free from defects in that the product is as described, fit for purpose, of satisfactory quality, and correctly installed (if the installation has been agreed as part of the contract). If the product does not conform to these requirements, the customer has certain legal rights: in accordance with applicable consumer law, the customer may obtain a full refund in the case of defective or incorrect delivery up to 3 days after delivery.
In case of defective or incorrect delivery, the product must be returned to Kinscent by contacting our customer service (see 11-2. Shipping and returns).

12.2. commercial warranty

Certain products sold on the Website carry a commercial warranty in addition to the legal warranty set forth in the preceding paragraph. The content and terms of this commercial warranty can be found on the “Contact Us” tab of this website and in the FAQs related to our products, so please review these terms before purchasing a product covered by this warranty.

13. Limitation of Liability

Under no circumstances may Kinscent be held liable for any damage not resulting from a failure on the part of Kinscent to comply with one of its obligations.

14. Governing law – disputes

These General terms of condintions of use shall be governed by and construed in accordance with the laws of Japan. In the event of any dispute, the Tokyo District Court shall have exclusive jurisdiction of the first instance, and you agree to submit to the exclusive jurisdiction of said court in accordance with the General terms of condintions of use.

You may make one copy of any web page on the kinscent.com website for your personal, private, non-commercial use, provided that all copyright (authorship) and other proprietary notices contained therein are retained in any such copy of the web page.

The kinscent.com website may contain links to third-party websites that are not published or controlled by Kinscent Co., Ltd.. Such links are provided as a convenience only and are not and shall not be construed as an express or implied endorsement of such websites, their content, or the products or services offered thereon.

We shall not be liable to you or to any third party for any indirect, incidental, special, or consequential damages, including, but not limited to, lost profits or other indirect losses, arising out of or in connection with the use or inability to use the kinscent.com website or any third party. This limitation of liability shall apply to the fullest extent permitted by law.

5. disclaimer of warranties

We do not warrant or represent that;

  • The kinscent.com website is free of viruses, data overwriting programs, Trojan horses, or other destructive material.
